1. Agreement to these terms
These Terms of Service (“Terms”) are a binding agreement between you and [Company legal name, e.g. Reclaimr, Inc.] (“Claim,” “we,” “us”) and govern your use of our website, apps and related services (the “Services”). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
2. Who can use the Services
You must be at least 18 years old and able to form a binding contract to use the Services. The Services are designed for residents of the United States. You may keep only one account, and you may use the Services only for yourself, not on behalf of other people, unless you are legally authorized to act for them.
3. What we do and don’t do
Claim collects publicly available information about class action settlements, explains it in plain English, suggests settlements that may match your answers, and helps you prepare and submit claims.
- We are not a law firm and do not provide legal, tax or financial advice. Using the Services does not create an attorney-client relationship.
- We are not affiliated with any court, class counsel, defendant or settlement administrator, unless we clearly say otherwise for a specific settlement.
- Matches are suggestions based on your answers. The court and the official settlement administrator alone decide who is eligible, how much is paid and when.
- You can always file a claim directly with the official administrator for free, without using Claim.
4. Your claims and responsibilities
Claim forms are usually signed under penalty of perjury. Only file claims for settlements you are genuinely eligible for, and only with information that is true, accurate and complete. Filing false or fraudulent claims may be a crime and may lead to your claims being rejected and your account being closed.
When you ask us to file a claim, you authorize us to prepare it using the information in your account and to submit it to the official administrator on your instruction. You are responsible for reviewing each claim before you submit it and for keeping your account information up to date. You also agree to respond to any request from an administrator for more information or documents.
5. No guarantee of payment
Payout amounts shown in the Services are estimates taken from settlement documents. The actual amount, if any, depends on the court’s approval, the number of valid claims and other factors outside our control. Settlements can be appealed, delayed or changed, and payments can take many months. We do not guarantee that any claim will be approved or paid, or the amount or timing of any payment.
6. Your account
You are responsible for keeping your login details confidential and for all activity under your account. Tell us right away at support@example.com if you believe your account has been accessed without permission.
7. Plans, billing and cancellation
Checking your eligibility and filing claims yourself are free. Some features are available only on a paid plan. Prices and what each plan includes are shown on our plans page and at checkout.
- Automatic renewal. Paid plans renew automatically at the end of each billing period (for example monthly) at the then-current price, and your payment method is charged unless you cancel before the renewal date.
- Cancel anytime. You can cancel online from your account, or by emailing support@example.com. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- Price changes. We will give you advance notice of any price increase, and you can cancel before it applies.
- Refunds. Except where required by law, payments are non-refundable and we do not provide refunds for partial billing periods. If you believe you were charged in error, contact us and we will review it.
Our fees are for access to the Services only. We never take a share of any settlement payment you receive.
8. Communications
By creating an account, you agree that we may send you service emails about your account and claims, such as deadline reminders and status updates. We will send marketing messages or text messages only with your consent. For texts, message and data rates may apply; reply STOP to opt out or HELP for help. You can unsubscribe from marketing emails at any time.
9. Acceptable use
You agree not to:
- submit false, duplicate or fraudulent claims, or claims for other people;
- impersonate anyone or misrepresent your identity or eligibility;
- scrape, copy or harvest content or data from the Services by automated means without our written permission;
- interfere with, disrupt or try to gain unauthorized access to the Services or other users’ accounts;
- reverse engineer the Services, except where the law expressly allows it; or
- use the Services in violation of any law.
10. Third-party sites and official forms
The Services link to official settlement websites, claim forms and other third-party services that we do not control. Those sites have their own terms and privacy policies, and we are not responsible for their content, availability or practices.
11. Our content and your license
The Services, including our software, design, text, explainers and logos, are owned by us or our licensors and are protected by law. We grant you a limited, personal, non-exclusive, non-transferable and revocable license to use the Services for your own non-commercial purposes in line with these Terms.
Settlement documents, court records and company names belong to their respective owners and are used for informational purposes. If you send us feedback or suggestions, we may use them without any obligation to you.
12. Suspension and termination
You may stop using the Services and close your account at any time. We may suspend or close your account if you violate these Terms, if we suspect fraud, or if we are required to by law. Sections that by their nature should survive termination, including disclaimers, limitations of liability and dispute terms, will survive.
13. Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that settlement information is complete, current or error-free, or that the Services will be uninterrupted or secure.
14. Limitation of liability
To the fullest extent permitted by law, Claim and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost profits, lost settlement payments or missed deadlines, arising from or related to your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim arose or US $100.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold Claim harmless from claims, losses and expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Services, or any false information you submit in a claim.
16. Governing law and disputes
These Terms are governed by the laws of the State of [State] and applicable U.S. federal law, without regard to conflict-of-law rules.
Before filing any claim against us, you agree to first contact us at legal@example.com and try to resolve the dispute informally for at least 30 days. If it is not resolved, either party may bring the dispute in the state or federal courts located in [State], and both parties consent to their jurisdiction. Either party may instead bring an individual claim in small claims court if it qualifies. Nothing here limits any right you have under consumer protection laws that cannot be waived.
17. Changes to these terms
We may update these Terms from time to time. We will post the updated Terms here and change the date at the top. For material changes, we will notify you by email or through the Services before they take effect. Continuing to use the Services after the changes take effect means you accept them.
18. General terms
These Terms and the Privacy Policy are the entire agreement between you and us about the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
